US Federal Law
As with marijuana, psychedelic substances are still illegal at the federal level, with the exception of DEA-exempted research and religious use.
US Decriminalization at City and State Level
Within the United States there is a growing decriminalization movement, pushing for the decriminalization of psychedelic plants and fungi. Several cities have passed related measures, and now Oregon and Colorado have also passed statewide measures. In those states, the possibility of offering legally-protected guided experiences, outside of established healthcare facilities, is being explored.
US Legal Religious Use
Religious Freedom Restoration Act
There is also some legal protection under the Religious Freedom Restoration Act (RFRA) for ceremonial practices within the United States. The utilization of sacred plant medicines within an established religion has been protected under RFRA officially, at the federal level, thus far, in only three cases. Each one of these spiritual communities are quite discreet, each with its own protocols regarding participation. These religions are recognized federally and have been given an exemption for sacramental use by the DEA (Drug Enforcement Administration).
